This E-Sign and Electronic Communication Notice (the “Notice”) explains how Clave Technologies Ltd (“Clave”, “we”, “us”, or “our”) delivers electronic communications, agreements, documents, notices, and disclosures (collectively, “Communications”) to you electronically.
By agreeing to this Notice, you consent to receive all Communications from Clave electronically and acknowledge that you will receive agreements, updates, and required notices in digital form, and you authorise Clave to accept electronic signatures in place of handwritten ones for legally binding transactions or agreements within the Clave mobile app (the “App”).
Consent to Use Electronic Signatures
You acknowledge that electronic signatures are legally binding and enforceable in the same manner as physical handwritten signatures, provided that the person signing the document intends to authenticate it and any formalities relating to the execution of that document are satisfied.
By signing up for Clave’s services (the “Services”) and using the Clave App, you agree that your registration constitutes an electronic signature, and you consent to receiving all legally required notices and communications digitally.
If you are an account administrator, you are responsible for ensuring that all authorised users in your organisation also consent to receiving electronic Communications.
Electronic Delivery of Communication
By agreeing to this Notice, you consent to Clave providing Communications digitally. This includes, but is not limited to:
Agreements and policies you accept (e.g., Terms of Service, Privacy Policy), including future updates;
Account-related information, such as account details, history, transaction confirmations, and security alerts;
Regulatory, legal, and tax disclosures, as required by law; and
Customer support responses, claims, and notices related to your use of Clave’s Services.
Clave may provide Communications through posting on the Clave App, sending to your primary email address registered with the App, in-app messages, and/or push notifications. Please note it is your responsibility to ensure that your contact details are accurate and that you can receive Communications from us.
Hardware and App Requirements
To access and retain electronic Communications, you will need the following hardware and software:
A device with internet connection;
A valid and up-to-date email address (registered with Clave);
A web browser that supports 128-bit encryption (latest versions of Chrome, Firefox, Microsoft Edge, or Safari recommended);
Software capable of viewing, saving, and printing PDF files (e.g., Adobe Reader 4.0 or higher); and
Sufficient storage space or access to printer to retain copies of Communications.
It is your responsibility to ensure that your device settings allow you to receive and store Communications.
We reserve the right, at our sole discretion, to provide Communications in paper form. Upon request, we may provide a paper copy of an electronic Communication and may charge a reasonable fee for printing and mailing unless prohibited by law.
Withdrawing Consent
You may withdraw your consent to receive Communications electronically at any time by contacting us at info@clave.team. If you withdraw consent, Clave may be required to immediately close your Clave account or charge additional fees for providing paper copies. Withdrawal of consent does not affect the legal validity of any Communications already received electronically.
Updating Your Contact Information
You must provide true, accurate, and complete contact details and ensure they remain up to date.
If Clave sends an electronic Communication but you fail to receive it due to an outdated or incorrect email address, the Communication will still be considered delivered. You can update your contact details by logging into your Clave account and updating your information, contacting our support team via the Clave App, or emailing us at info@clave.team.
Changes to This Notice
We reserve the right to amend the terms of this Notice at any time. Any amendments will be communicated electronically and will take effect immediately upon notification. Continued use of our Services after such changes constitutes your acceptance of the updated terms.
